do we not already have self defence laws that are not being adhered to? a person has the right to use as much force as reasonably necessary to protect themselves or the lives of others up to and including lethal force, weapon, intent and deliver system, I was taught this at my local Justice institute here in BC and spent 23 years practicing this law and now to say we need different laws? I also think there should be concealed carry in Canada and a specific course for that very reason. As for home invasions specifically, I would agree with 100% lethal force and a "Castle Law." I also think governments are political morons following a foreign influence to undermine all Canadians, look at the stupidity that comes out of their mouths, Bill Blair really comes to mind and I think his actions speak for themselves and now this new moron who is completely unqualified for the job, we can't keep recycling these government dipshits.

I would like to comment on the issue of "self defence", which has been highlighted again recently with the case in Lindsay (homeowner stabbing suspect), but as you well know this issue rears it's head every couple of years or so whenever a homeowner defends his family or property. You highlighted two such cases -- another one from Lindsay involving the guy with the crossbow, and the case from Collingwood where the homeowner spent 6 months in jail after his arrest. My argument regarding the "self defence" law(s) in Canada is that they are not really clear what the parameters and limits are, and what is reasonable force. I don't know that we have much direction from Case law defining these parameters either. Before Mr. Polievre introduces his new self defence legislation, we need cases to go before the courts , preferably with Jury trials, to get decisions defining what the current status of the law is now. You mentioned that the Lindsay case involving the home invasion with the cross-bow, the charges were eventually dropped against the homeowner. I am sure this was a welcome relief for the home owner, but really what is needed is for a case like that to go through the courts and get decisions on whether his actions were reasonable in the circumstances -- we need this realm clearly defined. And that will only happen with cases like the most recent one in Lindsay getting litigated in court. I realize that everyone is furious at the police for charging the homeowner for stabbing/cutting this suspect, but whether his actions crossed the line or not is a question of Law which must be decided by the courts, not the police. I don't know what happened to the homeowner in the Collingwood case you described, whether the case ever made it to court or not. But holding the homeowner in jail for 6 months after his arrest seems entirely unjust, assuming of course that he was not a risk to the public, or had warrants out for his arrest on other matters, etc -- you know what I mean. Once we can get a reading from the Courts as to what the parameters and limits are regarding self defense, especially as it relates to defending family and residence, then Mr. Polievre, or whoever succeeds him, can better craft a Bill that will address actual shortcomings of the current law as defined by the Courts. This will involve some public consultation and discussion of course, but Canadians deserve to have laws that protect them, and to know and fully understand what they are authorized to do and what are the limitations defined by the law. The problem is that we don't have that currently in Canada and it is a source of confusion and frustration for the public and in some cases the police as well. Anyhow, that's my 2¢ worth on the status of the "self defense" laws in Canada at present. I disagree in letting the courts decide to set precedent, it is simple, bring in a castke law that states any force is reasonable the moment a criminal enters your property..no grey areas. After a few robbers are shot dead it will make the others think twice..of course the lieberals are trying to ban all guns so Canadians can't fight back against criminals or the tyranny and authoritarianism that the government has planned.
We desperately need an election and get a government that works for Canadian taxpayers and all Canadians first. Home defenders don't have an arsenal of suitable defense tools. They just use what is handy in desperation to chase an attacker away from their family and/or to gain an opportunity to escape harm and call for help. Home defenders are also not trained enough to be able to determine if an attacker is subdued enough for a family to escape.
