My take on it is deeper in implication, if the Crown holds illegitimate power to guarantee freehold title insofar as property rights. The courts have upheld that view now twice & essentially reversed validity of a rather fundamental purpose for colonial governance institutions. Since 'governance of land' is such a significant historical purpose and foundation of sovereignty for any nation, this in parallel undermines the authority of courts who take their power from government.
By virtue of the court decisions in BC, inherently they not only erase the authority of the Crown government but also consequently the very judicial system appointed by government. It would appear they have erased their own legitimacy at the same time since in ruling to turn land back to its original occupants, they sweep away the very foundations of colonial power, which are ultimately 'land-based' claims of authority.
They just don't perhaps realize yet the fuller cascading implication of such ideological based rulings.
But the Indigenous Nations and other citizens of this former nation will soon come to realize what their governments and courts have just done.
Turn back the hands of time too hastily and the only questions remaining are: 1. Who's laws now govern the land? 2. To whom do we pay taxes going forward if governments (incl. Municipalities) lack authority to uphold land they once regulated? 3. And who will now pay the salaries of elected officials, bureaucratic institutions and judiciary?
The answer to all 3 would appear to be a collection of historically geo-dynamic Indigenous Nations.
