Peter Best writes, "The worst thing that can happen to a property owner isn’t a flood or a leaky foundation. It’s learning that you don’t own your property – that an Aboriginal band does."
Judges are out of control . They are not elected and laws are passed by parliament . They are elected by the people . Judges have no say in what laws they like or dislike . They can quit or note their complaint but have no power to act . This was brought by the Liberals who control the courts and police and we have allowed it to happen . The Supreme court has no say in changing the constitution or charter . If they did we have no need for government passing laws that the courts can just enforce or erase at their will . Let the people elect them .
Mark Carney is asking the Supreme Court of Canada to strike down the Notwithstanding clause in our constitution. He is recognizing the power of an unelected body over what was agreed upon by elected Premiers in 1982.
I agree with you that we, the people should have more input into who are judges are. There also should be more accountability for their decisions i.e. if they let a known murderer/rapist/pedophile go on or little to no bail and that person immediately reoffends, the judge should be fired.
This case in BC needs to be reversed. The precedent threatens property rights. Who would want to buy a house (if they could AFFORD it) or invest in our country?
You have it right . Judges should not be making legislation . They rule by the laws on the books . They DO NOT make up their own or throw out the ones they don't like . Liberals have allowed this because they own the courts . If the shoe was on the other foot they would be screaming murder . The head of the supreme court should have been removed long ago .
The horses "judges" have exited the barn, and NOW you suggest we close the barn door. The people who own the barn "governments" (humans we elected) are now riding away on the horses. What's next???
Richard Wagner, Chief Justice of the Supeeme Court of Canada, Pierre Trudeau, Jean Cretien, and Justin Trudeau all attended the Jean-De-Brebeuf private boarding school in Montreal.
Trudeau voiced that, you will own nothing and be happy. All part of the Globalist 2030 Agenda, UN, WEF and WHO in which Carney held top positions. God or Someone help us all!
At 78 years old I've watched my Canada collapse to almost a 3rd world country. So glad I saw Canada the BEST it EVER was. I fear for Canadians not even born yet what kind of horrible, Communist country they will struggle in.
The people of BC need to wake up and smell their governement and judiciary's totalitariansim...They will own nothing and probably not be happy...Who in their right mind would actually want to purchase property or land in BC now? You would have to be insane, financially reckless or plain mad....There is no reason at all for me to ever set foot in BC ever again, even though I have family in the lower mainlaind (Sodom and Gomorrah).... BC has become an insane asylum of perverted, sick demented society with their free drugs and anything goes lifestyles of demented and perverted ideologies of social behavor....Even the BC judges and judiciary institutions are so woke and insane they are now operating in full rogue mode and just making up and interpreting the law according to their own personal extreme beliefs. The BC judiciary must be partaking and imbibing in the same drugs as the rest of the drug addicted BC population. What a bizzaro world of whack jobs and demented craziness BC society has become.....
....and like a cancer it is spreading across the major population centers of Canada.... BTW ... has anyone bothered to look at a map of former aboriginal territory (a multitude of tribes) in Canada or North America for that matter?
I need to find and read the entire Peter Best article. I have also read his book, "There Is No Difference" - an examination of the reserve system. And I just noted he also has a website: "There Is No Difference."
What intrigues me is the question of taxes that have been paid in this BC area, as well as intense development, construction and upgrades occurring over the centuries. The list goes on. If one is awarded developed properties and infrastructures, then are there not development costs awarded to governments and property owners? And who decides? A lone judge? There has been a massive inheritance awarded here? Grampa Smith's meadow of 150 years ago has become a huge thriving dairy farm with 350 cows, eight huge outbuildings, robotic milking, farm equipment, a farmhouse, and fenced developed farmlands to provide foodstuffs for the cows. How is that factored in?
And, dang, why do we hear so little of this kind of "intellectual property"; that is, the development, innovations, inventions, conveniences and luxuries that favour us all, including indigenous peoples who, too, benefit from our massively developed nation?
So often we take it for granted: Drive on our well-maintained roads and rails in cars or buses or subways to the stores and find endless foodstuffs, equipment, supplies, necessities, technology, support systems. Our garbage is picked up; there are hospitals, paramedics, firemen, police; there is order, stability, parklands, arenas, community centres + + + We live in a land of plenty, a land developed over centuries. Is there no merit attributed to all this when we all benefit? Emphasis on all. As our dear scribe Rex Murphy once penned about this developed nation: We have a lamentable lack of gratitude.
Let us consider leaving this industry of division and resentment and offer wonder at what is available to us all in this (still) First World nation. We are all blessed beyond belief.
I bet that anything that we do to stop the insane judges and reverse the Liberals handing over Canada to the UN (UNDRIP), will result in Carney crying "Insurrection". BC's NDP government is following the beat of someone's drum but ultimately Canada is in big trouble
It seems to me the poverty stricken indigenous people living in our society are taking advantage of the current mindset where they are "victims" of the "white colonialists" who took their land, and so now they must pay dearly. But there's a lot more to it than that.
The government gives them all kinds of concessions, tax breaks, and other financial help but apparently it never seems to be enough. When they get their money, which wasn't earned, but "owed" to them, it's not used responsibly or distributed fairly. They stay poor for this reason and more. The victim mentality is no longer appropriate but is perpetuated by dysfunctional ideological policies.
They've become a burden on our country, getting benefits while not contributing for taxes like the rest of us, and their "indian" status ensures there will be division and favoritism.
The woke Eby Health Care bureaucrats even provided nice warm private hospital rooms to enable junkies to legally overdose on free drugs so they wouldn't be offended. At least no ambulance trips were wasted.
As a followup to my post- does anyone know the name of the judge that decided junkies had the right to use drugs in hospital rooms and in school playgrounds?
This is all part of the greater plan. UNDRIP is responsible for this nonsense and people need to wake up and start educating themselves. All the alphabet agencies need to be abolished: UN, WHO, NATO, WEF
Another door is opened for the Indian Industry to continue to suck the taxpayers dry. How many more $ billions is it going to take for the one sided " reconciliation " program to reach a conclusion.
The supreme joke (pun intended) is that all of this judicial business was done to achieve “reconciliation” and somehow move the Indian underclass up the ladder. It has done the opposite - caused intense division, and that underclass remains dependent and resentful
This is the beginning of the end of BC. Who would want to invest there if this is not overturned on appeal? Individuals and businesses alike will be keeping their money invested elsewhere.
Not just BC. It's a disease that will spread across canada. Remember the movies of cowboys and Indians warring and killing in the millions. It's on its way back. I guess libtards like their spaghetti westerns.
It has come to this…. In Canada’s national anthem the words “our home and native land” should now read “our home OR native land?”. We are no longer free in Canada when we willingly give up on what made us a country in the first place. All countries are formed through conquest by those who hold to a set of unified convictions. When the ‘west’ adopted the ‘multicultural’ mindset, the concept and identity of what Canada was, as a country, became watered down to whatever voices were the loudest. It has become anathema to proclaim something to be true. It is popular to disregard objective standards in favour of feelings of the perceived oppressor. Maybe we will go the way of Europe? The UK is increasingly becoming a muslim country. Not because they necessarily have the majority but because the rest of society doesn’t stand for anything. Muslim countries only have freedoms to the extent that those in charge allow those freedoms. Canada is on the verge of losing the true freedoms it was once known for.
I think the perpetual land acknowledgements from the opera to the board room are a brainwashing tactic, similar to what one might imagine would occur in a cult.
That's not a new thing. If you watch any of the international realty shows, you'll see that people quite often think they've bought a house in a country, or a piece of property only to have someone show up whose family owned it several hundred years ago and they still have a legal claim to it.
They have written title too, signed by the crown. You can keep up with your attitude but that's just perpetuating the problem here in Canada. This has been going on since before Confederation. One of the mistakes that John A McDonald made was to lead a government that didn't have proper representation by the indigenous; who would have made up the largest part of the population at the time. This isn't unique to Canada, or North America. If you watch International real estate shows, every now and again you'll see a situation where someone has bought a piece of property in another country, and then just as they're prepared to move in, someone shows up with documentation, claiming ownership from several hundred years before. At the very least it means a delay in taking ownership and a larger legal charges.
There is no need to look any farther than looking at who appointed the judges that are making these decisions. They are appointed by the prime Minister. There is where the buck stops.
If this is what the indian thinks, then they need to pay back the 100s of billion dollars they took from us. Game over, put your money where you mouth is.

.
I guess that should be no surprise . They are in lock step .
You will own nothing.
You will be happy.
Sound familiar...
The morons at the WEF of which our current PM was (and likely still is) a principle said that one.
They just forgot to mention anything about moronic NDP governments, corrupt/woke judges and of course Indigenous types.
Imagine being ruled by the Liberals, Indians, and UNDRIP. The US dodged a bullet by electing Trump.
Indeed.
Canada unfortunately appears to be headed to the scrapheap of what was supposed to be a Democratic country which appropriate values.
In reality that started in 1968 with a Liberal/Marxist Law Professor by the name of Pierre Trudeau.
His spawn (if indeed it was not Castro's) was sent by the usual suspect to finish the job.
Carney is here to make sure THE JOB IS FINISHED.
When one judge can remove 100's of properties from their rightful owners it is truly a One Judge Dictatorship.
Trudeau voiced that, you will own nothing and be happy. All part of the Globalist 2030 Agenda, UN, WEF and WHO in which Carney held top positions. God or Someone help us all!

Alas, in more ways than one :^(

Hopefully the next land claim is an area that judge young's house is.
This ruling should not be recognised, judges do not have the authority to make laws.
Very least change her street name to some unwritten dictionary that has no pronunciation.
This is all part of the greater plan. UNDRIP is responsible for this nonsense and people need to wake up and start educating themselves. All the alphabet agencies need to be abolished: UN, WHO, NATO, WEF
Everyone in Canada is at risk now! Carney is a dangerous PM who was Never elected by the people! We need an election NOW
Not the citizens of Alberta and Saskatchewan. We signed an agreement to provide the the natives with health care, education and land in reservations.
And they still whine, complain and demand more.
Another door is opened for the Indian Industry to continue to suck the taxpayers dry. How many more $ billions is it going to take for the one sided " reconciliation " program to reach a conclusion.

Any provinces that have adopted UNDRIP will be the first ones to fall.

Let them produce the paperwork that they own it.
They have it. It's called treaty agreements
They can stick their treaty up their arse.
I have a written title.
They have written title too, signed by the crown. You can keep up with your attitude but that's just perpetuating the problem here in Canada. This has been going on since before Confederation.
