Just because we dont have an explicit castle doctrine doesnt mean we are not legally allowed to defend ourselves up to and including lethal consequences. The current situation in this regard is the result of ideologically driven policing and courts that ignore our rights, putting criminals first. The US is experiencing similar circumstances.

Unfortunately in Canada, it seems you are only allowed to defend yourself with lesser force - i.e you can defend yourself in a gun attack with a knife, in a knife attack with bare hands (no judo/karate allowed) or in a physical attack with a pillow :-( Of course if the attacker is a member of any 'special' group or identity, the victim has no rights :-(

I believe the terms involve the word reasonable. Of course, the court decides what that means. A man in Bolton recently had charges dropped after using a firearm lethally. He had video of the intruder attacking his elderly mother. I guess the crown thought the bad optics were not worth it. Either way, we are screwed in this fascist country.

At least in some areas of the US a homeowner can shoot and kill home intruders without fear of prosecution.

From my last career and over 20 years of training;

A person has the right to defend themselves and the life of others with as much force as reasonably necessary up to and including lethal force, weapon, intent and delivery system also come into play.

Break into my house, intent, come at me with a "tool/weapon/bic pen" and the person is the delivery system

(I'm not a lawyer and never had to use this, a lawyer should chime in)

Similar to what I have said. I am no lawyer either but as a firearms owner, I have been interested in this subject for obvious reasons. As I said though, authorities in Canada no longer care about our rights under the law.

The politicians are very afraid. They know that they are losing power over the citizen and are deathly afraid that there is going to be a series of separations from Canada which will include Quebec, Alberta and Saskatchewan to begin with.

"They" want to take away our guns (or any measure to protect ourselves) so people can't defend their castle. The more bizarro world the better for the gov't, and when the population at large is subdued, this is psychological tactic to make the "good guys" feel helpless and therefore we won't have the mental capacity to stand up for ourselves. Who would want this besides an authoritarian gov't??

It elected and unbelievably keeps re-electeding the liberal party, although no doubt the last election has issues of corruption within elections Canada, one doesn't lose 121000 votes and also recount unbelievably close results in some ridings that nearly all magically swung red in seeking a liberal majority.

I will take my chances in court.....with 12 of my peers taking a baseball bat to an intruder's face. Let the chips fall where they may but I am certainly not going to sit there and let them A. come into my home.... B. assault me or anyone in my family and not protect them or myself. In what world is that a crime.....oh I know.....the Liberal hell hole Canada is surely becoming.

If the intruder hadn't illegally broken in, he would not have gotten hurt. I like the Florida "Stand your ground" rule which they advertise widely. If you break into someone's home you may be killed. What's wrong with that? The police who laid the charges should be fired immediately and the charges dropped. Another reason for Alberta separation.

Regardless of what bureaucrats dictate, all persons have a natural right to defend their homes, their families and themselves from intruders. Obviously the "law" being enforced is defective, as are the politicians and police officers enforcing this abomination. In the absence of a peace officer, citizens have an obligation to uphold the law. It is apparent that this home owner did the right thing, and that the law is in fact unlawful. Disgraceful product of Liberal DEI and ESG.

Indeed Tom, I know a woman who told me she voted for Justin "because he had nice hair". The first Trudeau was bad enough... a joke gone bad. Now Carney, the water boy for the W.E.F. is not only not bright, but he is rabid in his lust for unilateral dictum, and fervent in his boyish obedience to his masters in Geneva. Canada is doomed by woke officials and seduced CEO's who cannot wake up from their fantastical dream world. I have no intention of complying with their sick agenda.

This is wrong when criminals have more rights than the person or persons are defending their homes and family. This crime should've taken place in the first place. The courts let's these people back on the streets to coment crimes again and again. This man should take the courts to court and charge them for letting this guy out on bail to break into this man's home. This gives criminals a green light to do whatever they want because they know they have more rights and will be out on bail the next day. Dear God what is happening in Canada 🇨🇦.

If the charges aren't dropped one can only hope a jury sends a message and acquits the homeowner and attaches a scathing statement critisising the government, the law, the police and crown to that verdict. It is ghe dame in the UK, pity the criminal, pity the immigrant.

In the meantime the owner has to deal with this. Very stressful. If that guy didn't break in and come equipped, then this would not have happened. but once the bad guys figure nothing will happen, it will get worse. Thats why those making these rules live in gated communities.

A guy in Binbrook, ON that the jury acquitted for shooting and killing an Indian stealing his truck and threatening him got thrown in jail for 6 years after the Indian lobby and the government appealed it to make him an example.

The pigs can make like the birds and flock off. Especially these Kawartha and the OPP pigs. To deny me the right to fight even up to and including killing is not in the power of any man and more so, having to kill to preserve the life of anyone is a Sovereign right and not the right of any mere human to forbid. I have always said I will kill to defend any woman if need be to protect her from harm. And I have proven my ability in that by way of a lesser capacity act but I would have and will kill if needed to prevent murder and even grievous harm to come to others.

The damned OPP pigs and now the Kawartha pigs think they are a god out there and while I have respect to a few nobody will tell me I cannot use lethal force to preserve my life or other innocent lives. You see, violence is a good thing because it is the only thing that will work when nothing else will.

American law enforcement I have found over decades to be trustworthy, honest and fair are the type one can have some respect for. I have met many over the years and have yet to see any who are incompetent. A few years ago a knee grow attacked a patrol officer and wounded him. He was sitting on top of him beating him and a man came along, pulled his pistol, and told the knee grow to stop or he would shoot. The knee grow continued and died a fast death.

With what I hear and I hear a lot this would not happen here in Canuckistan where the pigs have murdered unarmed elderly semi retired gunsmiths as well as raped drunken women as well as trampling elderly retired and disabled woman. It is no wonder they are hated. The new useless DIEverSHITty crowd is now out there and hated beyond description.
