Constitutional lawyer says Carney is wrong about independence law

Constitutional lawyer Keith Wilson says that Carney is “wrong about the law,” arguing that a Supreme Court ruling from 1998 supersedes The Clarity Act, which is a federal statute.

A constitutional lawyer is criticizing Prime Minister Mark Carney over his comments on the Clarity Act and referendum questions on separation, arguing that parliamentarians are responsible for determining whether a referendum question meets the required threshold of clarity.

Carney made the remarks last week when asked about Alberta separation, saying that “we as Parliamentarians have a direct responsibility to judge the clarity of the question that meets those standards, and other standards.”
